      Terms and Conditions for Drivers

      These Terms of Use (“Terms”) govern your access to or use, as a natural person, from any location within the territory of the Republic of Cuba, of this application and the services (the “Services”) made available by “55”.

      Read these terms carefully before accessing or using the services.

      1. Conditions   

      This technological platform is used under the COOPERATIVE PRODUCTION AGREEMENT WITH TAXIS CUBA, in which the latter provides the portfolio of taxis linked to its activity of picking up natural persons.

      TAXIS CUBA is solely and absolutely responsible for the information it provides about the taxi drivers in the TAXISCUBA fleet who will be linked to the "55" platform.

      2. The Services:

      "55" is an app that allows taxi drivers who have an agreement with TAXIS CUBA to pick up passengers, guaranteeing an excellent service.

      Drivers may be used, if they agree, for conditions supplementary to the Services, such as policies for an event, activity, or particular promotion, and such supplementary conditions will be communicated to them in relation to the applicable Services. 

      Supplemental terms are set out in addition to the Terms and will be deemed a part of the Terms for the purposes of the applicable Services. Supplemental terms will prevail over the Terms in the event of a conflict with respect to the applicable Services.

      You agree to use the Application lawfully and in accordance with these Terms.

      Drivers will be held responsible if they knowingly associate themselves with illegal or discriminatory activities that violate users' rights.

      The application is prohibited from being used for:

      • Transmit viruses, malware, or any other malicious code.

      • Interfering with Application security.

      3. Privacy Policy

      This app guarantees the protection of our drivers' data in accordance with current legislation for the Republic of Cuba.

      4. Intellectual Property

      "55" is a technology platform that connects taxi drivers and passengers (users) through their mobile devices.

      "55" is developed by PYXEL SOLUTIONS SRL, and does not infringe or violate the intellectual or industrial property rights or any other legal or contractual rights of third parties.

      Reproduction, modification, reverse engineering, and any other method that implies changes to this platform from a technical, visual, or any other point of view, without the author's authorization, are prohibited.

      Any controversy arising from the interpretation or execution of the provisions of this contract shall be resolved by the parties in a friendly manner and acting in good faith. If no agreement is reached, the differences arising between the parties will be submitted to the jurisdiction of the commercial section of the competent Court of the Republic of Cuba.

      5. Drivers

      The driver must maintain proper conduct towards users, and must not express discriminatory opinions based on race, gender, or sexual orientation.

      The driver must comply with what is established by traffic laws and maintain responsible behavior on the road.

      Neither the app nor its owner, nor TAXIS CUBA, are responsible for any indiscipline committed on the road by the driver.

      The user has the right to rate drivers.

      6. Transportation Services

      Drivers are independent and not employees of "55," therefore "55" is not responsible for the quality, safety, or legality of the Services offered.

      7. Rates and Payments

      • The fees for the Services will be calculated and presented in the Application before the trip is confirmed.
      • Payments will be processed through the payment methods available in the Application.
      • "55" reserves the right to modify the rates and commissions.

      8. Cancellation Policy

      • Users can cancel a trip within a specified time frame without incurring charges.
      • Cancellations made after this deadline may be subject to cancellation fees.

      9. Ratings and Reviews  

      Users can rate and leave comments about Drivers. “55” reserves the right to moderate and remove inappropriate reviews.

      10. Limitation of Liability

      "55" will not be liable for direct, indirect, incidental, or consequential damages resulting from the driver's undisciplined or disorganized use of the Application or the Services.

      11.  Modifications of the Terms

      "55" reserves the right to modify these Terms at any time. Changes will be posted in the Application, and your continued use will constitute your acceptance of those changes.

      12. Applicable Law

      These Terms shall be governed by Cuban law. Any dispute arising in connection with these Terms shall be resolved in the competent people's court.

      General provisions.

      You may not assign or transfer these Conditions, in whole or in part, without the prior written consent of 55. You approve of 55 assigning or transferring these Conditions, in whole or in part, including to: (i) a subsidiary or affiliate; (ii) an acquirer of 55's equity, business, or assets; or (iii) a successor by merger. No joint venture, partnership, employment, or agency relationship exists between you, 55, or any Third-Party provider as a result of the contract between you and 55 or your use of the Services. If any provision of these Conditions is deemed illegal, void, or unenforceable, whether in whole or in part, under any legislation, such provision or part thereof shall be deemed not to form part of these Conditions, although the legality, validity, and enforceability of the remaining provisions of these Conditions shall not be affected. In that case, the parties shall replace such illegal, void, or unenforceable (part of a) provision with a legal, valid, and enforceable (part of a) provision that has, as far as possible, a similar effect to that of the illegal, void, or unenforceable (part of a) provision, given the contents and purpose of these Conditions. These Conditions constitute the entire agreement and understanding between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous agreements or arrangements with respect to such subject matter. In these Conditions, the words "included/a/os/as" and "includes/n" mean "included, but not limited to."
